When people hear the term sharia financing, many immediately associate it with "interest-free." But behind that term lies a fairly detailed legal framework that governs how sharia financing may operate in Indonesia, who has the authority to determine whether it complies with sharia principles, and how those principles become legally binding.

For business owners and financial institutions alike, understanding this legal framework is important for administrative compliance. More than that, this understanding ensures that the financing products being used have a legitimate and clear legal foundation.

The Law as the Primary Foundation

The legal basis for sharia financing in Indonesia is rooted in Law No. 21 of 2008 on Sharia Banking. This law is the first legal framework that explicitly requires sharia financial institutions to operate in accordance with sharia principles.

It also grants authority to the Indonesian Ulema Council (MUI), exercised through its specialized body, the National Sharia Board (DSN-MUI), to issue fatwas on whether a financial product complies with sharia principles.

The Role of DSN-MUI Fatwas: Guidance, Not Automatically Binding

DSN-MUI fatwas serve as the primary reference for determining whether a contract or financing product complies with sharia principles, covering everything from murabahah, mudharabah, and musyarakah, to ijarah and dozens of other contracts issued by DSN-MUI over time. It's important to understand, however, that a fatwa is fundamentally religious guidance and doesn't automatically carry the force of positive law. To become legally binding on financial institutions, a DSN-MUI fatwa needs to be transformed into an official regulation, such as a Bank Indonesia Regulation (PBI), an OJK Regulation (POJK), or an OJK Circular Letter (SEOJK). This process is what turns sharia principles, originally a religious view, into provisions that can be supervised and enforced by the relevant authority.

Indonesia's Financial Services Authority (OJK) issues various regulations that serve as the technical reference for sharia financial institutions in running their products and activities, including POJK No. 24/POJK.03/2015 on Sharia Bank and Sharia Business Unit Products and Activities, as well as POJK No. 25 of 2023 on the Business Operations of Venture Capital and Sharia Venture Capital Companies. Each of these regulations typically references specific DSN-MUI fatwa numbers as the basis for its drafting, creating a traceable line from religious fatwa to legally binding rule.

In other words, a sharia financing product can only be offered to the public after receiving a compliance fatwa from DSN-MUI and a license from OJK, meaning sharia compliance isn't just a matter of belief but also a matter of verifiable legality.

Why This Layered Legal Framework Matters

This layered legal structure, from law to fatwa to OJK regulation, delivers two benefits at once:

  • Religious consistency. The Sharia principles applied remain consistent because they originate from DSN-MUI's studies.
  • Legal certainty. These provisions can be enforced and supervised by official authorities, not merely informal agreements between financial institutions and customers.

For business owners considering sharia financing, understanding this framework helps assess whether a product is genuinely grounded in a clear fatwa and regulatory basis, or simply carries a sharia label without adequate legal structure behind it.
